A Supplementary Protection Certificate (SPC) is a unique intellectual property right for active ingredients of human and veterinary medicinal products requiring marketing authorisation. Challenging a patentee’s legal entitlement to claim priority is a common tactic in contentious proceedings in Europe. If successful, the patent can be held invalid by the effect of intervening prior art. This situation arose in a recent high-profile case before the Board of Appeal of the European Patent Office in decision T844/18. As reported in October here, from today, 1 April 2014, the deadline for filing divisional patent applications at the EPO (European Patent Office) will no longer apply. The rule setting the deadline was introduced in 2010 but was unpopular with applicants. After a period of consultation, the EPO decided to scrap the rule and return Rule 36 to a form closer to that prevailing before the 2010 change. J A Kemp held a workshop jointly with Aon, the insurance provider, focused on helping UK businesses of all shapes and sizes to make the most of their intellectual property (IP) assets and manage risk. The workshop ran from 2.30pm to 6.30pm at Aon's offices in Birmingham on 30 September. The session covered the types of IP protection available and explain, in particular, the role of patents and trade marks in supporting business objectives. The risk management agenda will include guidance on avoiding the impact of third party IP and mitigating other IP-related business risks.

Partner Geoff Woods spoke on the topic of European Patent Practice at the 2013 IP Seminar organised by Yokohama City, Japan. The seminar took place on 2 July 2013 at the Yokohama Media Business Center. Geoff's talk focussed in particular on the patentability at the European Patent Office of computer-implemented inventions and of medical use inventions, on the use of functional features in claims of European patent applications and on recent developments towards the European Union Unitary Patent. It was attended by about 70 delegates from companies and academic institutions in Yokohama and the surrounding area.

J A Kemp used clean technology case studies to analyse the strategies followed to protect the commercial value embedded in the technology.
