Ravi will be speaking on the first day on the topic of evergreening (or life cycle management patents): including polymorphs and patents arising from clinical trial data.
This session delves into strategies for identifying opportunities for, and successfully prosecuting and defending, downstream patent applications filed after a large or small therapeutic product is in the public domain. We will look at some case studies on how to work through the clinical trial data before publication to identify any patentable inventions. We will also consider the vulnerability of such downstream patents to challenge in the European and US courts, looking in particular at patents on polymorphs of small molecule drugs and patents on specific dosage regimens.
