A recent decision of the EPO Technical board of Appeal (T0630/11/Waterleaf) provides some welcome clarification of the EPO’s approach to assessing non-technical constraints when considering the inventive step of mixed inventions (inventions including both technical and non-technical features).
Our briefing on this matter can be found here.
The EPO have also recently updated the Guidelines for examining computer implemented inventions. Our briefing on the examination of inventions involving user interfaces (data input) can be found here and our briefing on the examination of inventions involving presentations of information (data output) can be found here.
Clients interested in further information on the patenting of computer implemented inventions are encouraged to contact their usual J A Kemp contact or John Leeming at our London office.
