UPC Sunrise Opt Outs – One Month Down, Two Months to Go
After a false start, the IT systems of the Unified Patent Court seem finally to be up and running as expected. J A Kemp has already filed nearly 800 opt out requests, including patents, applications and patents with SPCs, using the software it developed in-house for bulk automatic opt outs. This is about 6% of the total number of opt out requests filed so far at the UPC.
There are only two months of the sunrise period left. After the end of the sunrise period on 1 June third parties will be able centrally to attack any European patents not opted out. Clients are encouraged to finalise lists of cases to be opted out as soon as possible. The UPC has said it expects its IT systems to come under pressure in the final weeks before the UPC opens its doors and IP owners are warned to avoid leaving opt outs until the last minute.
